CoHome, as you will also see referred throughout this page as “we”, “us” or “our”, is in the business of matching one or more homebuyers to their dream home. Thank you for trusting us with your information and helping us provide you with a great service on our platform. By implementing this Privacy Policy, we want to make sure that the information you provide us stays protected and handled appropriately.

Please check out this Privacy Policy to understand all the types of personal information that we collect from you through our services (“Services”) when you set up an account with us (“Account”) and through our website at cohome.com (“Site”) as well as how we use your information, who we share your information with, your rights regarding your information and how you can contact us should you have any questions or requests regarding your information. This Privacy Policy does not apply to any third-party websites, platforms, applications, products or services, whether we refer to them on our website or they refer to our website in their content. Please refer to the privacy practices of such third parties to understand how they protect and use your information.

This Policy applies to you whether you visit our website, become a registered user (“Member”), use our platform and services as a real estate agent registering with us in such capacity (“Agent”) become a member of a group of users interested in becoming real estate co-owners (“Co-Buy Group”), check the real estate properties listed on our Site (“Listings”) or use any other feature of our Site.

1. What type of information is covered under this Privacy Policy

Personal information is information that identifies, relates to, or could reasonably be linked with you or your household.

We collect personal information that:

(i) you provide to us directly and through your use of our Site or Services;

(ii) our service providers and other third parties lawfully provide to us; and

(iii) publicly available sources provide information about you.

Our Services and Site are not directed to individuals residing outside the United States of America.

We do not knowingly collect any personal information form such individuals. Please contact us by following the instructions in the “Contact us” section if you believe that we collected or used any such information.

We collect the following type of personal information from you:

(i) Member Registration Information, that is information that you provide to us when you set up your Account on our platform to become a Member, including your name, contact details, gender, age, relationship information, employment information, various financial information (including your monthly spending and credit score).

(ii) Agent Registration Information, that is information that you, in your professional capacity as a real estate agent, provide to us to set up your Account on our platform and become an Agent, including your name, personal and professional contact information, real estate license number, real estate brokerage firm information.

(iii) Profile Information, that is additional information that you as a Member or Agent provide when you choose to use certain functionalities of our platform, such as real estate purchase preferences, your calendar availability, real estate listings.

(iv) Communication Information, that is information that you choose to provide while communicating with us, including when you choose to fill in a form, participate in promotions or marketing campaigns, communicate with our team (either with our customer support or other team), or information that you choose to communicate to other Members or Agents, including when you choose to message or respond to a Member or Agent through our platform.

(v) Automatically Collected Information, that is information that we may automatically collect from you about your use of our services, whether such information is used to identify you or in a non-identifiable manner without reference to your personal information, including information about your Internet Protocol (IP) address, Global Positioning System (GPS) location of your mobile device, information that we may gather through our cookies, web beacons, pixels, server logs and other similar technologies, information regarding your use of our website and platform even when you did not register as a Member or Agent on our platform, information regarding your searches on our platform, whether of other Members, Agents or any listings on our platform.

(vi) Identity Verification Information, that is information that we may collect from you specifically for the purpose of verifying your identity as a Member or Agent or your professional credentials as an Agent, as may be applicable.

We collect the following type of information from our service providers and other third parties:

(i) Financial Information, that is information made available to us through your use, as a Member, of https://plaid.com (“Plaid”) as redirected from our Site, including information regarding your income, spending, and assets.

(ii) Privately Checked Background Information, that is information regarding your personal and criminal record made available to us through https://www.checkr.com (“Checkr”) and that may be disclosed to other Members and Agents that you allow through your choice to join a Co-Buy Group.

(iii) Reviews, that is information that another Member or Agent has provided about you, that will be published on your Member or Agent public profile page on our platform with your consent.

(iv) Contact Information, Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you wish to be removed from receiving future communications, you can opt out by texting STOP.

We collect the following type of information about you from publicly available sources:

(i) Publicly Available Background Information, to the extent permitted by applicable laws, that is information that we may obtain about you from public records (by using your Member or Agent Registration Information that you provide to us to access such public records), including your criminal convictions or sex offender registrations.

2. Why we collect and process your personal information

We may collect, use, store and process your personal information to:

(i) Provide you with Services, such as providing you with access to and use of our Site and Services; enabling you to communicate with other Members or Agents and join a Co-Buy Group; operating, protecting, and optimizing our Site and Services, providing customer and other Site and Services related support; contacting you regarding any customer support or service questions, Account notifications, alerts, updates; preventing fraud; profiling your information to suggest matchings to Co-Buy Groups, Agents and Listings; verifying the information you provide; conducting verifications against background and police records; performing any action that you authorize us at the time of collection of your personal information.

(ii) Improve our Services and Site, by using analytics to determine ongoing Services and improve your experience with our Site and Services, by administering our review program and acting on complaints or suggestions from users regarding our Site and Service; send you administrative emails regarding the changes to the operation of our Site and Services and other similar notifications; develop new services; monitor and improve the use and satisfaction of our Services.

(iii) Market and advertise to you, by sending you notifications, marketing, advertising and other information that may be of interest to you; personalizing our advertisements and marketing materials; administering promotional activities or events.

(iv) Comply with legal obligations and requests, respond to legal or administrative claims or requests, enforce our Terms of Service or any other contract we may have with you, protect our users, protect our rights and property, by disclosing information to courts, law enforcement, governmental authorities, tax authorities, and other authorized parties in order to comply. Where appropriate, we may notify you about any such use and disclosure unless prohibited by law, court order or legal process, or if we believe that such notification would be futile, ineffective, create a risk of injury, bodily harm or fraud.

(iii) Reviews and ratings are part of your public profile, whether you are a Member or Agent.

3.2 Sharing with other Members and Agents

As part of the management and use of your Account that we provide on our platform, you will be able to choose what, if any, information is available for view and disclosed to other Members and Agents:

(i) when you contact other Members or Agents, certain information may be shared with such Members or Agents including your visible profile, your history of use of our Site or Services such as whether you have previously purchased property through the use of our Site and Services, your reviews and ratings that other Members or Agents have provided about you.

(ii) when you request to join a Co-Buy Group, we will share your full profile information with your consent, including but not limited to information regarding your background checks, financial information, preferences.

3.4 Sharing with third-party service providers

We do not control any third-party service providers and are not responsible for the privacy or security practices of our third-party service providers. Please check the privacy policies of the individual service-providers listed here about the policies they have in place.

As part of the anti-fraud and security features of our Site and Services, we may disclose your information with our third-party providers:

(i) Checkr, to receive and check your criminal and sex-offender background information;

(ii) Plaid, to receive and check your financial background information and credentials;

(iii) Insurance providers, to assess, handle, and process any insurance and similar claims;

(iv) Other third-party service providers, to assess, handle, and process any legal claims.

As part of our effort to improve our business and your experience with our Site and Services, we use the following service providers that may use cookies, pixels, beacons and other tracking and analytics technologies:

(i) Google Analytics, to track and receive reports about online traffic to our website;

(ii) MailChimp, to improve our marketing and communication with you, as well as develop and provide you with more relevant services.

(iii) Sakari, Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. Any other mentions in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. If you wish to be removed from receiving future communications, you can opt out by texting STOP.

By using our Site and Services, you consent to be bound by Checker's privacy policy, Plaid’s privacy policy, Google’s privacy policy, MailChimp’s privacy policy and Sakari’s privacy policy.

3.5 Sharing with, transfers or sale to other third parties

(i) Business Transactions. We may share, transfer or sell your information as part of a business transaction, such as a merger or acquisition, sale of assets, reorganization, bankruptcy or similar transactions. We will notify you before your information is transferred to another entity or become subject to a different privacy policy.

(ii)Governmental authorities, whether local, state or federal level. We may disclose your information to governmental authorities to comply with legal obligations and requests, respond to legal or administrative claims or requests, enforce our Terms of Service or any other contract we may have with you, protect our users, protect our rights and property, and other similar purposes.

Our Site and Services may contain links to third-party providers. We do not own or control such third-party providers. 4. What are your rights

As a user of our Site and Services you may exercise any of the rights below as may be applicable to you in your jurisdiction and under the limitations of the same jurisdiction’s laws or laws applicable to us:

(ii) Control the amount of publicly available information by using the visibility feature in your Account and through your Account settings.

We will be happy to help you update such information if you contact us using the “Contact Us” section below. Please note that we reserve the right to use your previously collected information to establish your identity.

(iv) You can request us to delete your information. However, please note that this right may be limited by our legal obligation to retain your information under applicable tax and other laws or court orders or court-imposed obligations; or by our legitimate business purposes such as to prevent or detect fraud or to enhance safety. If we delete your information, please note that residual copies of your information may still be maintained in our backup system for a limited period of time to protect CoHome from accidental or malicious loss or destruction.

(v) You have the right to withdraw your consent to our processing of your information by changing your Account’s settings. In such case, please note that your request is valid only as to future processing of information. Such withdrawal will not invalidate the lawful processing done previously to such withdrawal.

(vi) California Residents:

If you are a California resident, California provides you as a consumer with certain rights under the California Consumer Privacy Act (CCPA) regarding our use and disclosure of your personal information:

You may request that we disclose to you free of charge what personal information we have collected, used, shared, or sold about you, and why we collected, used, shared, or sold such information, for the 12-month period preceding your request. Specifically, you may request that we disclose:

Please note that you must prove your identity by providing a government-issued identification document. We use our reasonable efforts to protect our users’ personal information and to prevent loss, misuse, unauthorized access, and other unlawful interference with a user’s information. Please note however that no Internet transmission or electronic storage method is fully secure and we cannot guarantee absolute security of our user’s information.
